1. Acceptance of Terms

By accessing, registering for, or using Hot4Sales.com (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you must not use our services.

2. Role of Hot4Sales

Hot4Sales operates as an intermediary marketplace connecting domain buyers and sellers. We do not own the domains listed on the Platform (unless explicitly stated otherwise). We provide the technology to facilitate negotiations, listings, and secure transactions through approved third-party Escrow services.

3. Seller Obligations and Anti-Fraud Policy

• Proof of Ownership: Sellers must legally own or have the explicit legal right to sell any domain listed. Listing stolen, hijacked, or trademark-infringing domains is strictly prohibited.
• Platform Circumvention: Any attempt by a buyer or seller to circumvent the Platform's negotiation or payment systems to avoid our commission fees will result in immediate, permanent account termination and potential legal action for breach of contract.
• Accurate Information: Sellers must provide truthful information regarding domain traffic, revenue, and history. Misrepresentation constitutes fraud.

4. Buyer Obligations

• Binding Offers: When you submit an offer or click "Buy Now", you are entering into a legally binding agreement to purchase the domain at that price if accepted.
• Payment: Buyers must fund the Escrow transaction within the stipulated timeframe (usually 48-72 hours) upon offer acceptance. Failure to fund an accepted offer may result in a ban from the Platform.

5. Escrow and Security

To protect both parties, Hot4Sales mandates the use of approved, top-tier Escrow services for domain transactions. Hot4Sales acts as a transparent third-party guarantor during this process. However, Hot4Sales shall not be held liable for any technical failures, delays, or disputes arising directly from the third-party Escrow provider's actions.

6. Fees and Commissions

• Basic listing of domains is completely free.
• Hot4Sales charges a commission (typically 5% to 10%) only upon the successful completion of a sale via our "Private Brokerage" or "Private Negotiation" services.
• No Refunds: Fees paid for premium placements (e.g., "Top Premium Domain" list, "Featured" section) or monthly subscriptions are strictly non-refundable, regardless of whether the domain sells.

7. Adult Content ("Sex & Adult" Category)

Domains that imply or relate to adult content must be listed exclusively in the designated "Sex & Adult" category. We reserve the right to re-categorize or remove domains that violate this policy or contain illegal explicit material.

8. Limitation of Liability

In no event shall Hot4Sales, its directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform. Our total liability in any matter related to the Platform is limited to the total fees paid by you to Hot4Sales in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users of the Platform, us, or third parties, or for any other reason.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
